MINUTES

 

 

 

The Uvalde County Commissioners Court met in regular session at 10:00 a.m. on November 13, 2007 in the Commissioners Courtroom of the Uvalde County Courthouse, with the following members present:

                                                Jerry W. Bates, Commissioner #3

                                                Jesse R. Moreno, Commissioner #4

                                                John P. Dodson, County Attorney

                                                Lucille C. Hutcherson, County Clerk and Ex-Officio Clerk

                                                            of the Commissioners Court of Uvalde County

 

Mariano Pargas, Jr. presented his letter of resignation as Commissioner #2

effective November 10, 2007 to the Court.  A copy of said letter is attached to

these minutes.

 

Also present were County Treasurer Joni Deorsam, District Clerk Lydia Steele, County Auditor Alice Chapman, and Road Administrator Jesse Garcia.

 

1.                  CONSIDER AND ACT UPON CALL TO ORDER, ROLL CALL AND PLEDGE OF ALLEGIANCE:

The Honorable William R. Mitchell called the meeting of November 13, 2007 to order; gave the invocation; led the pledge of allegiance to the United States of America and Texas flags.

 

2.                  CONSIDER AND ACT UPON APPROVAL OF MINUTES:

·         Upon motion of Commissioner Moreno

·         Second by Commissioner Bates

The Court unanimously (3-0) approved the Minutes of October 22, 2007, as presented.

3.                  CONSIDER AND ACT UPON NOTICE TO PETITION TO CLOSE, ABANDON, VACATE, DISCONTINUE, CHANGE AND SHORTEN THE WESTERLY PROTION OF COUNTY ROAD 360 IN UVALDE COUNTY:

Attorney William A. Kessler on behalf of Lou Waters of Utopia, Texas, presented the Court with a Notice of Petition to Close, Abandon, Vacate, Discontinue, Change, and Shorten the Westerly Portion of County Road 360 in Uvalde County, Texas, along with the Petition.  The Court was informed

that the approximate 1.63 mile portion of CR 360 and adjoining property are currently owned by Mr. Waters.  Mr. Kessler also stated that it is the intent of Mr. Waters to give the adjacent land owners a 20 foot non-exclusive easement in case of flooding.

The Court unanimously (3-0) approved the adoption of an Order Closing, Abandoning, Vacating, Discontinuing, Changing, and Shortening The Westerly 1.63 Mile Portion Of County Road 360 In Uvalde County, Texas.

4.                  CONSIDER AND ACT UPON DISTRICT CLERK’S REQUEST FOR ADDITIONAL EMPLOYEE:

District Clerk Lydia Steele appeared before the Court requesting an additional staff person so her office can assist citizens with passport applications and continue with the regular duties of said office.

The Court unanimously (3-0) approved the request of the District Clerk for an additional employee.

5.                  CONSIDER AND ACT UPON BAN ON OUTDOOR BURNING:

·         Upon motion of Commissioner Moreno

·         Second by Commissioner Scheide

Due to the lack of rain, the Court unanimously (3-0) approved an Order Restricting Outdoor Burning.  Said order is adopted pursuant to Local Government Code 352.08 and other applicable statues.  A copy of the same is attached to these minutes.

6.                  CONSIDER AND ACT UPON LEASE AGREEMENT FOR JP 4 OFFICE:

·         Upon motion of Commissioner Moreno

·         Second by Commissioner Scheide

The Court unanimously (3-0) approved a Lease Agreement between the County and Carlos O. Roman to house the office of JP #4.  A copy of said lease is attached to these minutes.

7.                  CONSIDER AND ACT UPON OPEN AND AWARD OF BIDS/PROPOSALS:

The following bids/proposals were open, acknowledged and will be awarded at the next meeting of the Court.

      -Office of Rural Community Affairs (ORCA) for Specially Authorized

  Public Facilities and Improvements:

            1)  Esser & Company of Uvalde

                              2)  Community Development Management Company of Lockhart

                        -County Hotel/Motel Tax:

                                    1)  Texas Hill Country River Region of Uvalde

                                    2)  Zachary Associates of Abilene

 

8.                  CONSIDER AND ACT UPON ROAD ADMINISTRATORS REPORT:

Road Administrator Jesse Garcia gave the following activity report, with no action being taken.

                  -Spreading crush base on CR# 309

                  -Maintenance around the Sabinal area

                  -Cutting brush

                  -Fema update

 

9.                  CONSIDER AND ACT UPON LINE ITEM BUDGET AMENDMENTS:

The Court unanimously (3-0) approved the line item budget amendments presented by the County Auditor.
