The Uvalde County Commissioners Court met in regular session on September 25, 2006 at 10:00 a.m. in the Uvalde County Commissioners Courtroom, with the following members present:

 

                                                William R. Mitchell, County Judge

                                                Randy Scheide, Commissioner #1

                                                Mariano Pargas, Jr., Commissioner #2

                                                Jerry W. Bates, Commissioner #3

                                                Jesse R. Moreno, Commissioner #4

                                                Lucille C. Hutcherson, County Clerk and Ex-Officio Clerk

                                                            of the Commissioners Court of Uvalde County

 

                        ABSENT:       John P. Dodson, County Attorney

 

Also present were County Treasurer Joni Deorsam; County Tax Assessor-Collector Maggie Del Toro; County Auditor Alice Chapman; and Road Administrator Wayne Everett.

 

1.                  CONSIDER AND ACT UPON CALL TO ORDER, PRAYER AND PLEDGE OF ALLEGIANCE:

The Honorable William R. Mitchell gave the invocation; led the pledge of allegiance to the United States of America and Texas flags.

2.                  CONSIDER AND ACT UPON APPROVAL OF MINUTES:

·         Upon motion of Commissioner Moreno

·         Second by Commissioner Bates

The minutes of September 11, 2006 were unanimously (4-0) approved as written.

3.                  CONSIDER AND ACT UPON PROPOSAL CONTRACT FOR COLLECTION OF CLASS C MISDEMEANORS:

·         Upon motion of Commissioner Moreno

·         Second by Commissioner Pargas

The Court unanimously (4-0) approved an ORDER authorizing delinquent fees accessed by the Uvalde County Justices of the Peace Courts be collected by Linebarger Goggan Blair & Sampson, LLP of San Antonio.  A copy of said

4.                  CONSIDER AND ACT UPON ADOPTING PROPOSED SUBDIVISION RULES AND REGULATIONS:

·         Upon motion of Commissioner Scheide

·         Second by Commissioner Pargas

The Court unanimously (4-0) approved the adoption of the proposed subdivision rules and regulations for Uvalde County, as recommended by the Committee, which consisted of Nick Fohn, Kyle Wilson, Gary Parker, C. E. Davis, and Wayne Everett.  The Court expressed their gratitude to the members of the committee and Sue Haynes for their assistance with this project.  The said committee was then discharged.

5.                  CONSIDER AND ACT UPON PRESENTATION BY JOE JOBST REGARDING MEDICAL INSURANCE:

The County’s agent of record, Joe Jobst of Employee Benefits of San Antonio, provided the Court with quotes from nine insurers.  Mr. Jobst explained that the County has a self-funded insurance; Group and Pension is the administrator; and after a full discussion he recommended the County select Alliance as the carrier.

·         Second by Commissioner Moreno

The Court unanimously (4-0) approved the recommendation of Joe Jobst and selected Alliance as the County’s insurance carrier.  A copy of the proposal is attached to these minutes.

6.                  CONSIDER AND ACT UPON ADOPTING PROPOSED GENERAL FUND TAX RATE:

·         Upon motion of Commissioner Scheide

·         Second by Commissioner Bates

The Court unanimously (5-0) approved an ORDER SETTING UVALDE COUNTY, TEXAS TAX RATE FOR 2006 as follows:

      General Fund Maintenance/Operating Expense Tax Rate      $ .4300

            Debt Service Tax Rate for General Fund                               $ .0091

7.                  CONSIDER AND ACT UPON ADOPTING PROPOSED ROAD AND FLOOD TAX RATE:

·         Upon motion of Commissioner Bates

·         Second by Commissioner Moreno

The Court unanimously (5-0) approved an ORDER SETTING UVALDE COUNTY, TEXAS TAX RATE FOR 2006 as follows:

      Farm Market-Flood Maintenance/Operating Expense Tax Rate   $ .0830

      Debt Service Rate for Farm Market-Flood                                    $ .0212

8.                  CONSIDER AND ACT UPON REQUEST TO ACCEPT ACACIA DRIVE AS A DEDICATED COUNTY ROAD:

This agenda item was table.

 

9.                  CONSIDER AND ACT UPON OUTDOOR BURN BAN:

·         Upon motion of Commissioner Pargas

·         Second by Commissioner Moreno

The Court unanimously (4-0) voted in favor of lifting the burn ban and requested that the citizens of Uvalde County exercise extreme caution when burning.

10.              CONSIDER AND ACT UPON DONATION FROM AEP:

·         Upon motion of Commissioner Bates

·         Second by Commissioner Moreno

The Court unanimously (4-0) approved to accept a contribution to the County of Uvalde Sesquicentennial Committee in the amount of $2000 from American Electric Power (AEP).

11.              CONSIDER AND ACT UPON DISTRICT ATTORNEY’S GRANT APPLICATION FROM THE TEXAS ATTORNEY GENERAL:

·         Upon motion of Commissioner Pargas

·         Second by Commissioner Bates

The Court unanimously (4-0) approved a RESOLUTION supporting the submission of a grant application for the 38th Judicial District Attorney’s Office to the Office of the Attorney General, Crime Victim Services Division.

12.              CONSIDER AND ACT UPON COUNTY ATTORNEY’S GRANT APPLICATION FROM THE TEXAS ATTORNEY GENERAL:

·         Upon motion of Commissioner Pargas

·         Second by Commissioner Moreno

The Court unanimously (4-0) approved a grant application for the County Attorney’s Office to the Office of the Attorney General, Crime Victim Services Division.  A copy of said STATEMENT OF GRANT AWARD is attached to these minutes.

13.              CONSIDER AND ACT UPON MANUEL CASTILLO’S REQUEST  

FOR TAX EXEMPTION STATUS:

Manuel Castillo, representing My Brothers Keeper, requested the Court grant a tax exemption to his organization.

·         Second by Commissioner Scheide

The Court unanimously (4-0) voted to table this request for further review.

14.              CONSIDER AND ACT UPON ROAD ADMINISTRATORS REPORT:

Road Administrator Wayne Everett gave the Court the following activity report, with no action taken:

-Repaired three roads in the Utopia area that were damaged during recent  

  rains

                        -Routine maintenance

 

15.              CONSIDER AND ACT UPON LINE-ITEM BUDGET AMENDMENTS:

None were presented to the Court for approval.

 

16.              CONSIDER AND ACT UPON PAYMENT OF BILLS:

·         Upon motion of Commissioner Bates

·         Second by Commissioner Scheide

The Court unanimously (4-0) voted to approve the bills for payment.

The Court approved a resolution in honor of the following individual, with the meeting being closed in her memory:

      Jodie Darley – widow of former County Judge Leo Darley
