MINUTES

 

 

The Uvalde County Commissioners Court met in regular session on September 11, 2006 at 10:00 a.m. in the Uvalde County Commissioners Courtroom, with the following members present:

 

                                                William R. Mitchell, County Judge

                                                Randy Scheide, Commissioner #1

                                                Mariano Pargas, Jr., Commissioner #2

                                                Jerry W. Bates, Commissioner #3

                                                Jesse R. Moreno, Commissioner #4

                                                Lucille C. Hutcherson, County Clerk and Ex-Officio Clerk

                                                            of the Commissioners Court of Uvalde County

 

                        ABSENT:        John P. Dodson, County Attorney

 

Also present were County Treasurer Joni Deorsam; County Tax Assessor-Collector Maggie Del Toro; County Auditor Alice Chapman; Road Administrator Wayne Everett; and Chief Deputy Sheriff Raul Medina.

 

1.                  CONSIDER AND ACT UPON CALL TO ORDER, PRAYER AND PLEDGE OF ALLEGIANCE:

The Honorable William R. Mitchell gave the invocation; led the pledge of allegiance to the United States of America and Texas flags.

 

The following proceedings were had:

 

2.                  CONSIDER AND ACT UPON APPROVAL OF MINUTES:

·        Upon motion of Commissioner Moreno

·        Second by Commissioner Bates

The Court unanimously approved the Minutes of the regular meeting of August 28, 2006 and the budget workshop which was also held on August 28, 2006.

 

3.                  CONSIDER AND ACT UPON PROPOSED CONTRACT FOR COLLECTION OF CLASS C MISDEMEANOR FINES:

Lupe Zamarripa, Dan Romo, and Steven D. Saucedo of Linebarger Goggan Blair & Sampson, LLP presented a proposal to the Court, for services for collection of class c misdemeanors for JP Courts only.

 

·        Upon motion of Commissioner Bates

·        Second by Commissioner Scheide

The Court voted 3-2 to table this item until further review.  Judge Mitchell, Commissioners Scheide and Bates voted AYE, with Commissioners Pargas and Moreno voting NAY. 

 

A copy of a Justice of the Peace accounts receivables report, prepared by the County Auditor, is attached to these minutes.

 

4.                  CONSIDER AND ACT UPON FINAL PLAT OF KNIPPA SOUTH ESTATES SUBDIVISION:

·        Upon motion of Commissioner Scheide

·        Second by Commissioner Pargas

The Court unanimously approved the final plat of Knippa South Estates Subdivision.

 

During discussion of this item, two individuals addressed the Court concerning their objections to this development.

 

5.                  CONSIDER AND ACT UPON FINAL PLAT OF KNIPPA NORTH ESTATES SUBDIVISION:

·        Upon motion of Commissioner Scheide

·        Second by Commissioner Pargas

The Court unanimously approved the final plat of Knippa North Estates Subdivision.

 

6.                  CONSIDER AND ACT UPON PUBLIC HEARING ON PROPOSED SUBDIVISION RULES AND REGULATIONS:

No citizen comments were made during the third and final public hearing on the proposed subdivision rules and regulations for Uvalde County.  The Court conducted the public hearing on this item at 10:40 a.m.  No action was taken under this agenda item. 

 

 

7.                  CONSIDER AND ACT UPON PUBLIC HEARING ON PROPOSED 2006-2007 UVALDE COUNTY TAX RATE:

This was the second of two required hearings on the proposed tax rate, with no action being taken.

 

The public hearing opened at 10:44 a.m. with the following persons expressing their concerns:

      George Ligocky – opposed the tax increase

      Julian Garza – opposed the tax increase

                        Road & Bridge Debt            .0212

                        Total Rate                              .5433

 

 

8.                  CONSIDER AND ACT UPON PUBLIC HEARING ON PROPOSED 2006-2007 UVALDE COUNTY BUDGET:

The Court conducted a public hearing regarding the proposed 2006-2007 budget at 10:50 a.m.  No comments were made by citizens concerning this matter, and no action was taken by the Court.

 

9.                  CONSIDER AND ACT UPON SALARY FUND:

·        Upon motion of Commissioner Scheide

·        Second by Commissioner Pargas

The Court unanimously approved the 2006-2007 salary fund, as presented by the County Auditor.  A copy of the salary fund is attached to the minutes.

 

10.              CONSIDER AND ACT UPON ADOPTING 2006-2007 UVALDE COUNTY BUDGET:

·        Upon motion of Commissioner Scheide

·        Second by Commissioner Bates

Judge Mitchell, Commissioners Scheide, Pargas, Bates, and Moreno voted 

 favor of adopting the 2006-2007 Uvalde County Budget.  A copy of the said budget is attached to these minutes.

 

11.              CONSIDER AND ACT UPON REQUEST TO EXTEND CR 407:

·        Upon motion of Commissioner Moreno

·        Second by Commissioner Scheide

The Court unanimously approved the request of Commissioner Moreno to extend CR #407 approximately 1 ˝ miles and include this portion in the County’s lateral road census.

 

12.              CONSIDER AND ACT UPON ROAD ADMINISTRATORS REPORT:

Road Administrator Wayne Everett gave the Court the following activity report, with no action being taken.

      -Routine maintenance

 

13.              CONSIDER AND ACT UPON LINE ITEM BUDGET AMENDMENTS:

·        Upon motion of Commissioner Scheide

·        Second by Commissioner Bates

The line item budget amendments were unanimously approved, as presented by the County Auditor.

 

14.              CONSIDER AND ACT UPON PAYMENT OF BILLS:

·        Upon motion of Commissioner Bates

·        Second by Commissioner Scheide

The bills were unanimously approved by the Court.

 

15.              CONSIDER AND ACT UPON PAYROLL APPROVAL:

·        Upon motion of Commissioner Moreno

·        Second by Commissioner Pargas

The payroll was unanimously approved by the Court.

 

16.              CONSIDER AND ACT UPON MONTHLY REPORTS:

·        Upon motion of Commissioner Pargas

·        Second by Commissioner Bates

The Court unanimously approved the following monthly reports.

      County Clerk: August, 2006 (bond); August 26-30, 2006

        Jail: August 21-28, 2006; August 28 thru September 4, 2006

        J.P. #1: August 14-18, 2006; August 21-25, 2006; August 28-31, 2006

        J.P. #2: August 21-25, 2006

        J.P. #3: August 1-31, 2006; August 19-25, 2006; August 26-31, 2006

        J.P. #4: August 21-25, 2006; August 28-31, 2006

17.              CONSIDER AND ACT UPON RESOLUTIONS/PROCLAMATIONS:

The Court approved resolutions in honor of the following with the meeting being closed in their memories.
