MINUTES

 

 

The Uvalde County Commissioners Court met in regular session at 10:00 a.m. on September 10, 2007 in the Commissioners Courtroom of the Uvalde County Courthouse, with the following members present:

                                                Mariano Pargas, Jr., Commissioner #2

                                                Jesse R. Moreno, Commissioner #4

                                                            of the Commissioners Court of Uvalde County

 

Also present were County Treasurer Joni Deorsam, County Sheriff Terry Crawford, County Auditor Alice Chapman, and Road Administrator Jesse Garcia.

 

1.                  CONSIDER AND ACT UPON CALL TO ORDER, ROLL CALL AND PLEDGE OF ALLEGIANCE:

The Honorable William R. Mitchell called the meeting of September 10, 2007 to order; gave the invocation; led the pledge of allegiance to the United States of America and Texas flags.

 

2.                  CONSIDER AND ACT UPON PRESENTATION OF LIFE SAVER AWARD:

The following is an excerpt of the presentation made by Judge Mitchell and Sheriff Crawford:

On July 21, 2007 during a time of dangerous flooding in Uvalde County, Carolyn Curry’s vehicle was washed off a low-water crossing and into the raging waters of the Dry Frio River.  Mrs. Curry exited the vehicle as it became submerged in the current and she clung to a tree.

Roy Glasscock and Jim White were able to take action to rescue Mrs. Curry and escort her to safety.

Roy Glasscock and Jim White are saluted, honored and recognized for their selfish act in coming to the rescue of Mrs. Curry.

4.                  CONSIDER AND ACT UPON OPENING OF BIDS/PROPOSALS:

The following bids were opened, set aside for review and public inspection and will be acted upon at the next meeting of the Court scheduled for September 24, 2007.

5.                  CONSIDER AND ACT UPON RATIFICATION OF TAX RATE REFLECTED IN PROPOSED BUDGET:

The following was read to the Court by Alice Chapman, County Auditor:

 

COUNTY OF UVALDE – HB 3195 STATEMENT

     “This General Fund budget will raise more total property taxes than last year’s budget by $231,470.97, and of that amount $83,913.07 is tax revenue to be raised from new property added to the tax roll this year.”

     “This Road & Bridge budget will raise more total property taxes than last year’s budget by $482,494.49, and of that amount $24,091.57 is tax revenue to be raised from new property added to the tax roll this year.”

The Court unanimously (4-0) approved to ratify the tax rate reflected in the proposed 2007-2008 budget.

6.                  CONSIDER AND ACT UPON PUBLIC HEARING ON PROPOSED TAX RATE FOR 2007-08:

The second of two public hearings was held concerning the proposed tax rate.  The first hearing was held at the Court’s meeting of August 27, 2007.  No action was taken under this agenda item.

 

Tax rates required to fund the 2007-2008 Uvalde County Budget are as follows:

                  General Fund Tax Rate:                       $    .4395

                  General Fund Debt Rate:         $    .0028

FM/Flood Tax Rate:                 $    .1267

FM/Flood Debt Rate:               $    .0007

TOTAL TAX RATE                $    .5697

 

Noel Troxclair was the only member of the public at the hearing and he spoke against any tax increases.

 

7.                  CONSIDER AND ACT UPON SETTING PUBLIC HEARING TO ADOPT PROPOSED TAX RATE:

Judge Mitchell recommended that the tax rate be adopted at a meeting of the Court set for Monday, September 24, 2007.  No action was taken under this agenda item.

 

8.                  CONSIDER AND ACT UPON ADOPTION OF 2007-2008 UVALDE COUNTY BUDGET:

·         Upon motion of Commissioner Scheide

·         Second by Commissioner Moreno

The Court unanimously (4-0) approved to adopt the 2007-2008 Uvalde County Budget.  The budget will be effective October 1, 2007 and a copy of the same is attached to these minutes.

9.                  CONSIDER AND ACT UPON ADOPTING UVALDE COUNTY SALARY FUND:

The Court unanimously (4-0) adopted the 2007-2008 salary fund, as certified by the County Treasurer and County Auditor.  A copy of the same is attached to these minutes.

10.              CONSIDER AND ACT UPON SHERIFF REQUEST TO PARTICIPATE IN OPERATION BORDER STAR:

Sheriff Crawford requested approval, from the Court, to enter into an

Interlocal Cooperation Contract with the Division of Emergency Management (GDEM), a division of the Office of the Governor. The State of Texas is to organize and deploy state agency and local government law enforcement personnel and equipment to participate in a project to enhance border security along the Texas-Mexico border by supplementing the border security efforts of Federal agencies.  The GDEM will provide funding to reimburse the County for its expenses relating to this project.

The Court unanimously (4-0) approved the request of Sheriff Crawford to enter into an Interlocal Cooperation Contract between Uvalde County and the Division of Emergency Management, as division of the Office of the Governor.  A copy of said contract is attached to these minutes.

11.              CONSIDER AND ACT UPON PROPOSED POLICY REGARDING USE OF PRIVATE VEHICLES WHILE CONDUCTING COUNTY BUSINESS:

·         Second by Commissioner Moreno

The Court unanimously (4-0) approved the following amendment to the Uvalde County Personnel Policy Manual, as recommended by Commissioners Scheide and Pargas. 

Policy on County Property section 3.02 item #3 was amended to read as follows:

Personal use of county vehicles, equipment, supplies, tools, county owned credit cards and other county property shall not be permitted at any time.  Misuse of County Property by an employee may subject them to Criminal prosecution under state law and/or termination of employment.

12.              CONSIDER AND ACT UPON ROAD ADMINISTRATORS REPORT:

Road Administrator Jesse Garcia gave the Court the following activity report, with no action being taken.

                  -River crossings repaired

                  -Mowing right-of-ways

                  -Blading roads

                  -Patching roads

 

13.              CONSIDER AND ACT UPON LINE-ITEM BUDGET AMENDMENTS:

None were presented to the Court for approval.
