MINUTES

 

 

 

The Uvalde County Commissioners Court met in regular session on August 8, 2005 at 10:00 a.m. in the Commissioners Courtroom of the Uvalde County Courthouse with the following members present:

 

                        PRESENT:       William R. Mitchell, County Judge

                                                Randy Scheide, Commissioner #1

                                                Mariano Pargas, Commissioner #2

                                                Jerry W. Bates, Commissioner #3

                                                John P. Dodson, County Attorney

                                                Lucille C. Hutcherson, County Clerk and Ex-Officio Clerk

                                                            of the Commissioners Court of Uvalde County

           

                        ABSENT:        Jesse R. Moreno, Commissioner #4

 

Also present were County Treasurer Joni Deorsam, County Tax Assessor-Collector Maggie Del Toro, County Sheriff Terry Crawford, and Road Administrator Wayne Everett.

 

The Court opened with the Honorable William R. Mitchell giving the invocation; the following proceedings were had:

 

1.                  CONSIDER AND ACT UPON APPROVAL OF MINUTES:

·        Upon motion of Commissioner Bates

·        Second by Commissioner Pargas

The minutes of July 25, 2005 were unanimously approved as presented.

 

2.                  CONSIDER AND ACT UPON APPOINTING ELECTION JUDGES:

·        Upon motion of Commissioner Scheide

·        Second by Commissioner Bates

The Court unanimously approved the First Amended List of Judges/Alternates for the August 2005-July 2006 Term, as presented by County Election Official Maggie Del Toro.  A copy of said list is attached to these minutes.

 

3.                  CONSIDER AND ACT UPON DISTRICT COURT ORDER SETTING SALARY FOR COUNTY AUDITOR, ASSISTANT COUNTY AUDITOR AND OFFICIAL COURT REPORTER:

·        Upon motion of Commissioner Scheide

·        Second by Commissioner Pargas

The Court unanimously approved the ORDER SETTING SALARY OF COUNTY AUDITOR, ORDER SETTING SALARY OF ASSISTANT COUNTY AUDITOR and ORDER SETTING SALARY of OFFICIAL COURT REPORTER signed by Mickey R Pennington, District Judge of the 38th Judicial District.  Certified copies of the same are attached to these minutes.

 

4.                  CONSIDER AND ACT UPON RESOLUTION REQUESTING TEXAS DEPARTMENT OF TRANSPORTATION SELL SURPLUS PROPERTY TO UVALDE COUNTY FOR FIRE DEPARTMENT BUILDING:

Judge Mitchell informed the Court that the Texas Department of Transportation has declared surplus some property they own near the intersection of US 83 and FM 1050.  The Concan Volunteer Fire Department is searching for land in the Garner Park area to build a fire station.

 

·        Upon motion of Commissioner Bates

·        Second by Commissioner Pargas

The Court unanimously approved a resolution requesting said property described by TxDOT control number 0036-37 as the same being located near the intersection of US 83 and FM 1050 be made available to the County of Uvalde.  The motion also included deleting item #2 of the original resolution, which stated, “The County of Uvalde in exchange agrees to pay the appraised value of the property.”  A copy of the corrected resolution and map of said property in question is attached to these minutes.

 

5.                  DISCUSS TAX RATE: IF PROPOSED RATE WILL EXCEED THE ROLLBACK RATE OR THE EFFECTIVE TAX RATE (WHICHEVER IS LOWER). TAKE A RECORD VOTE AND SCHEDULE PUBLIC HEARING:

This item was not acted upon, as the values were not available from the appraisal district.

 

6.                  CONSIDER AND ACT UPON UPDATED CALENDAR FOR 2005-2006 UVALDE COUNTY BUDGET:

·        Upon motion of Commissioner Pargas

·        Second by Commissioner Bates

The Court unanimously approved the updated calendar for 2005-2006 Uvalde County budget.

 

7.                  CONSIDER AND ACT UPON CLASSIFICATION OF COUNTY ROADS:

·        Upon motion of Commissioner Scheide

·        Second by Commissioner Bates

The Court unanimously approved the recommendation of Judge Mitchell, County Attorney John P. Dodson and Road Administrator Wayne Everett to classify the Uvalde County roads as being third-class roads.  Attached to these minutes is a copy of the Transportation Code – Chapter 251.

 

 

8.                  CONSIDER AND ACT UPON ROAD ADMINISTRATORS REPORT:

Road Administrator Wayne Everett gave the following activity report:

      -Routine maintenance

      -Bridge construction update

No action was taken under this agenda item.

 

9.                  CONSIDER AND ACT UPON LINE –ITEM BUDGET AMENDMENTS:

None were presented for approval.

 

10.              CONSIDER AND ACT UPON PAYMENT OF BILLS:

·        Upon motion of Commissioner Bates

·        Second by Commissioner Scheide

The Court unanimously approved the bills for payment.

 

11.              CONSIDER AND ACT UPON APPROVAL OF MONTHLY REPORTS:

·        Upon motion of Commissioner Pargas

·        Second by Commissioner Bates

12.              CONSIDER AND ACT UPON PAYROLL APPROVAL:

·        Second by Commissioner Bates

The Court unanimously approved the payroll.

 

13.              CONSIDER AND ACT UPON RESOLUTIONS/PROCLAMATIONS:

The Court approved a resolution in honor of Evalyn S. Matthews, with the meeting being closed in her memory.

 

 

With no further business, the Honorable William R. Mitchell adjourned the meeting of August 8, 2005.
