MINUTES

 

 

 

The Uvalde County Commissioners Court met in regular session on July 11, 2005, at 10:00 a.m. in the Commissioners Courtroom of the Uvalde County Courthouse with the following members present:

 

                        PRESENT:       William R. Mitchell, County Judge

                                                Randy Scheide, Commissioner #1

                                                Jerry W. Bates, Commissioner #3

                                                Jesse R. Moreno, Commissioner #4

                                                John P. Dodson, County Attorney

                                                Lucille C. Hutcherson, County Clerk and Ex-Officio Clerk

                                                            of the Commissioners Court of Uvalde County

                        ABSENT:        Mariano Pargas, Jr., Commissioner #2

 

 

Also present were County Treasurer Joni Deorsam, Tax Assessor-Collector Maggie Del Toro, County Sheriff Terry Crawford, Constable #1 Bob Price, County Auditor Alice Chapman, and Road Administrator Wayne Everett.

 

The Court opened with the Honorable William R. Mitchell giving the invocation; the following proceedings were had:

 

1.                  CONSIDER AND ACT UPON APPROVAL OF MINUTES:

·        Upon motion of Commissioner Moreno

·        Second by Commissioner Bates

The Court unanimously approved the minutes of June 27, 2005.

 

2.                  CONSIDER AND ACT UPON OPENING OF BIDS:

The Court acknowledged the receipt of the following bids, with award to be acted upon at the meeting of July 25, 2005.  A copy of the bids is attached to these minutes.

a.                   Office Supplies

b.                  County Morgue

c.                   Pharmacy

d.                  Inmate Telephone

e.                   Road Department Uniforms

f.                    Sheriff Department Uniforms

g.                   Petroleum Products

 

3.                  CONSIDER AND ACT UPON ENACTING A BAN ON OUTDOOR BURNING:

·        Upon motion of Commissioner Scheide

·        Second by Commissioner Bates

The Court unanimously approved an ORDER PROHIBITING OUTDOOR BURNING.

 

The ban will be for 90 days unless the Court takes action to abolish and also allows for citations to be issued to violators with a punishment of up to a $500 fine.

 

4.                  CONSIDER AND ACT UPON APPOINTING ELECTION JUDGES:

·        Upon motion of Commissioner Scheide

·        Second by Commissioner Moreno

The Court unanimously approved the list of election judges and alternates for the August 2005-July 2006 term, as presented by County Election Official Maggie Del Toro.  Attached to these minutes is a copy of the list.

 

5.                  CONSIDER AND ACT UPON CALLING ELECTION FOR EMERGENCY SERVICE DISTRICT OFFICIALS:

·        Upon motion of Commissioner Bates

·        Second by Commissioner Moreno

The Court unanimously approved an ORDER OF ELECTION to allow for the selection of the Emergency Service District board of directors/commissioners.

Said election will be held November 8, 2005 in portions of voting precincts 2, 3, and 4.  A copy of the order is attached to these minutes.

 

6.                  CONSIDER AND ACT UPON RENEWAL OF VICTIMS OF CRIME GRANT:

·        Upon motion of Commissioner Moreno

·        Second by Commissioner Bates

The Court unanimously approved the renewal of the Victims of Crime grant, as requested by the County Attorney.  A copy of the Resolution in support of grant is attached to these minutes.

 

7.                  CONSIDER AND ACT UPON BUDGET AMENDMENT TO AUTHORIZE DEPUTY OVERTIME/PART TIME PAY:

Sheriff Crawford discussed the increased number of visitors to the County during the summer months, number of calls received and additional workload to the department.  The Sheriff requested funding to hire additional deputies; authorize overtime/part time pay to existing deputies or reserve deputies.

·        Second by Commissioner Scheide

The Court unanimously approved the request of Sheriff Crawford by allowing him to hire any combination thereof in order to provide enough assistance throughout the County to get through the 2005 Labor Day weekend.  Also included in the motion was approval of amending the 2004-2005 budget in the amount of $11695.00 to assist with funding of the additional temporary staff. The amendment will include the transfer $10000.00 from the Weather Modification budget to the Sheriff’s budget.

8.                  CONSIDER AND ACT UPON REQUEST TO CHANGE ROADS IN PRECINCT 3:

Judge Mitchell informed the Court that several residence have requested a change in CR #379 and #380 which is located in Commissioner Precinct #3.  By statute they must file an application, post it and then seek approval from the Court.  They have complied with the State requirements and now come before the Court for action.

 

A.  Public Hearing:

       Mr. Marshall McCrea informed the Court that it was his desire to    

       close/abandon all of County Road #380 and close/abandon a portion

 of County Road #279.  Mr. McCrea cited section 251.052 of the Texas                 Transportation Code in his request.

 

       No one spoke in opposition to the closure/abandonment of the two roads     

       in question.

·        Second by Commissioner Moreno

The Court unanimously approved the request to close/abandon CR #380 and close/abandon a portion of CR #279.  A copy of said APPLICATION TO CHANGE ROADS IN PRECINCT NO. 3 is attached to these minutes.

 

9.                  CONSIDER AND ACT UPON ROAD ADMINISTRATORS REPORT:

Road Administrator Wayne Everett gave the following activity report with no action taken:

                  -Update on construction of CR #414 crossing

                  -Routine maintenance

 

10.              CONSIDER AND ACT UPON LINE ITEM BUDGET AMENDMENTS:

None were presented to the Court for approval.

 

11.              CONSIDER AND ACT UPON PAYMENT OF BILLS:

·        Upon motion of Commissioner Bates

·        Second by Commissioner Scheide

The Court unanimously approved the bill for payment.

 

12.              CONSIDER AND ACT UPON PAYROLL APPROVAL:

·        Upon motion of Commissioner Moreno

·        Second by Commissioner Bates

The Court unanimously approved the payroll.

 

13.              CONSIDER AND ACT UPON APPROVAL OF MONTHLY REPORTS:

·        Upon motion of Commissioner Bates

·        Second by Commissioner Scheide

The Court unanimously approved monthly reports submitted by the following departments:

J.P. #1: March 28-31, 2005; June 13-17, 2005; June 27-30, 2005; June 2005; June 20-24,

             2005; July 1-8, 2005  

J.P. #2: June 20-24, 2005

J.P. #3: June 25-30, 2005; June 1-30, 2005

14.              CONSIDER AND ACT UPON RESOLUTIONS/PROCLAMATIONS:

The Court approved resolutions in honor of the following with the meeting being closed in the memory.
