MINUTES

 

 

 

 

The Uvalde County Commissioners Court met in regular session on April 25, 2005 at 10:00 a.m. in the Commissioners Courtroom of the Uvalde County Courthouse with the following members present:

 

                        PRESENT:       William R. Mitchell, County Judge

                                                Randy Scheide, Commissioner #1

                                                Mariano Pargas, Jr., Commissioner #2

                                                Jerry W. Bates, Commissioner #3

                                                Jesse R. Moreno, Commissioner #4

                                                John P. Dodson, County Attorney

                                                Lucille C. Hutcherson, County Clerk and Ex-Officio Clerk of

                                                            the Commissioners Court of Uvalde County

 

 

Also present were County Treasurer Joni Deorsam, Tax Assessor-Collector Maggie Del Toro, Sheriff Terry Crawford, Constable #1 Bob Price, County Auditor Alice Chapman, and Road Administrator Wayne Everett.

 

The Court opened with the Honorable William R. Mitchell giving the invocation; the following proceedings were had:

 

1.                  CONSIDER AND ACT UPON APPROVAL OF MINUTES:

·        Upon motion of Commissioner Moreno

·        Second by Commissioner Bates

The Court unanimously approved the Minutes of April 11, 2005.

 

2.                  CONSIDER AND ACT UPON OPENING OF BIDS:

The Court acknowledged the receipt of the following bids, which were set aside for review and examination.  Award of the same is scheduled for the meeting of May 9, 2005.

A.  Bank Depository:

                         First State Bank of Uvalde

                        Hondo National Bank

 

3.                  CONSIDER AND ACT UPON REQUEST OF SHERIFF TO ADD K-9 TO SHERIFF’S DEPARTMENT:

Sheriff Crawford requested approval from the Court to accept a retired drug dog that was being offered by the United States Customs.  The acceptance from the Court will allow that the K-9 be added to the County’s existing liability insurance. The Sheriff stated that all care, housing, training and any other expense related to the K-9 would be paid out of the drug forfeiture fund.

·        Second by Commissioner Bates

The Court unanimously approved the request of Sheriff Crawford.

 

4.                  CONSIDER AND ACT UPON MODIFYING VOTING PRECINCT LINES:

The Court recessed with action to be taken on this agenda item at 10:00 a.m. on April 29, 2005.

 

5.                  CONSIDER AND ACT UPON RESOLUTION SUPPORTING CHAGES IN VOTING PRECINCT LINES:

The Court recessed with action to be taken on this agenda item at 10:00 a.m. on April 29, 2005.

 

6.                  CONSIDER AND ACT UPON REPORT FROM HAVA COMMITTEE:

The County Clerk gave an update on HAVA compliant equipment demonstrations.  No action was taken under this item.

 

7.                  CONSIDER AND ACT UPON RESOLUTION SUPPORTING ZAVALA COUNTY’S REQUEST FOR STATE PARK AND THE NAMING THEREOF:

·        Upon motion of Commissioner Moreno

·        Second by Commissioner Pargas

The Court unanimously approved a Resolution endorsing and supporting the creation of a State Park in Zavala County.  The proposed park would consist of approximately 17.349 acres of land along the Nueces River.  A copy of the Resolution is attached to these minutes.

 

8.                  CONSIDER AND ACT UPON PRESENTATION OF FIRST DRAFT OF 2005-2006 UVALDE COUNTY BUDGET:

Judge Mitchell presented the first draft of the 2005-2006 Uvalde County Budget to the Court, with no action being taken.

 

9.                  CONSIDER AND ACT UPON ROAD ADMINISTRATORS REPORT:

No action was taken on Road Administrator Wayne Everett’s activity report:

      -Routine maintenance

      -Blading roads

      -Patching roads

      -Paved 1.4 miles of CR#428

      -Received permits from the Core of Engineers

      -Construction has begun on the Nueces River crossing at Montell

      -Working on a bypass road at the Nueces River crossing

 

10.              CONSIDER AND ACT UPON LINE-ITEM BUDGET AMENDMENTS:

None were presented to the Court.

 

11.              CONSIDER AND ACT UPON PAYMENT OF BILLS:

·        Upon motion of Commissioner Bates

·        Second by Commissioner Scheide

The Court unanimously approved the bills for payment.

 

12.              CONSIDER AND ACT UPON PAYROLL APPROVAL:

·        Upon motion of Commissioner Moreno

·        Second by Commissioner Bates

The Court unanimously approved the payroll.

 

13.              CONSIDER AND ACT UPON APPROVAL OF MONTHLY REPORTS:

·        Upon motion of Commissioner Pargas

·        Second by Commissioner Moreno

The Court unanimously approved the reports from the following departments:

      Jail: April 11, 2005; April 11-17, 2005; April 18, 2005; April 18-24, 2005; April 25, 2005

      J. P. #1: April 1-8, 2005; April 11-15, 2005; April 18-22, 2005

      J. P. #2: April 1-8, 2005; April 11-15, 2005

      J. P. #3: April 1-8, 2005; April 9-15, 2005

      J. P. #4: April 1-8, 2005; April 11-15, 2005

      J. P. #6: March 21-25, 2005; April 1-8, 2005; April 11-15, 2005; April 18-22, 2005

      County Clerk: April 1-7, 2005; April 8-14, 2005

        County Auditor: March, 2005

 

14.              CONSIDER AND ACT UPON RESOLUTIONS/PROCLAMATIONS:

·          Upon motion of Commissioner Bates

·          Second by Commissioner Moreno

The Court unanimously approved an Amended Resolution regarding the Help America Vote Act (HAVA).  A copy of said Resolution is attached  to these minutes along with the Help America Vote Act Grant Award Agreement.

 

The Court approved resolutions in honor of the following with the meeting being closed their memory.

                              Victoria Elizabeth Rodriguez

 

 

The Court recessed at 10:50 a.m. on April 25, 2005 and reconvened on April 29, 2005 at 10:00 a.m. with the following items being considered and acted upon:

4.                  CONSIDER AND ACT UPON MODIFYING VOTING PRECINCT LINES:

A.  Move Early Voting to Civic Center

·        Upon motion of Commissioner Moreno

·        Second by Commissioner Bates

The Court voted 3-1 to move the early voting location to the Reading Room at the Willie De Leon Civic Center, with Commissioner Pargas casting the descending vote.

 

B.   Move Precinct #1 Polling Place to Civic Center:

·        Upon motion of Commissioner Bates

·        Second by Commissioner Moreno

The Court voted 3-1 to move Voting Precinct #1 polling location to the Reading Room at the Willie Del Leon Civic Center, with Commissioner Pargas casting the descending vote.

 

C.  Locate Courthouse in Voting Precinct #1: 

·        Upon motion of Commissioner Moreno

·        Second by Commissioner

The Court unanimously approved locating the Courthouse wholly within  Precinct #1.

 

D.     Combine Voting Precincts #2 and #13:

·        Upon motion of Commissioner Bates

·        Second by Commissioner Pargas

The Court unanimously approved of consolidating Precinct #2 and #13, with the polling location for the new Precinct #2 to be the First Christian Church on Center Street in Sabinal, Texas.  This action eliminated the Sabinal City Hall location.

 

E.   Create New Precinct in Uvalde Estates:

·        No action was taken under this item.

 

F.   Accessible Polling Locations:

      1.     Upon motion of Commissioner Moreno

  Second by Commissioner Bates

        The Court unanimously approved to relocate the #17 polling    

                                 location from Flores School to the Bread of Life Fellowship Church

                                 at 700 North High Street.  The motion was just to include the church

                                 not the whole block, the precinct maps are to indicate the same.

 

 

                         2.     Upon motion of Commissioner Pargas

                                 Second by Commissioner Bates

                                 The Court unanimously approved to relocate polling location #19

                                 from Excel Academy at 169 Goldbeck Street to the New Testament

                                 Fellowship Church located at 220 Crisp Street.

 

5.                  CONSIDER AND ACT UPON RESOLUTION SUPPORTING CHANGE IN VOTING PRECINCT LINES:

·        Upon motion of Commissioner Moreno

·        Second by Commissioner Bates

The Court unanimously approved the Resolution supporting the changes.  A copy of the Resolution and maps reflecting the action of the Court are attached to these minutes.

 

 

With no further business, the Honorable William R. Mitchell adjourned the meeting of April 25, 2005.
